SYLVIA GARZA PEREZ MAKES CLEAR DUE PROCESS IS NOT PART OF HER JOB
In my lawsuit with the city and Texas Loan Star, Art McDonald recused himself without any basis allowed by the rules of judicial conduct. I am pursuing him with the Texas Supreme Court. I have delayed the mandamus because I was hopeful one of the parties was ready to settle. It is a case in my opinion wherein the client is ignoring good legal advice. I did not want this party to have to spend money responding to the mandamus if there was a chance of settlement. For now, the client has decided to roll the dice and fight - for now. When they get their bill for all the motions filed and lose, they will complain they are the victim.
So, I was allowed to object to the appointment of Gina Benavides. Sylvia Garza Perez has and continues to refuse to send the parties the order of assignment made by Judge Missy Medary of the new judge. It was signed and filed on September 17, 2025. I guess she just wants to lose the election.
These orders are sent via efile as serve only, or email. She claims she sent it today, but nope it was not sent by either of the required methods.
She knows there are timetables for me to object or possibly seek recusal.
I will ask the Texas Supreme Court to remove her from this case as unfit to ensure Due Process is filed.
I am moving forward on the mandamus against Missy Medary and Art McDonald now that the party I thought was going to settle has made it clear for now there is no settlement.
