COUNTY CLERK SYLVIA GARZA-PEREZ
IT IS ABSOLUTELY INCREDIBLE - BOTH CLERKS ARE ALLOWING THEIR STAFF TO PRACTICE LAW- IT WILL END
Yesterday the lawsuit which was to be filed in county court at law, was non-suited in district court and refiled in the county court at law. The style of the lawsuit clearly indicated it was intended to be filed in the county court, and the affidavit of indigence clearly had marked it was a case for the county court at law. This is all in the non-suit because we do not want anyone arguing forum shopping. Trust me with Judge McDonald the judge in the county court at law, I expect a fight. I have already established in the case of Josefina Fisher he had no regard for the law and is a willing participant with Saenz to violate people's rights. McDonald can challenge me on this, but the record is there. That case was dismissed after a visiting judge found there was no legal basis for the alleged crime.
Yesterday I lost an hour dealing with a county clerk who claimed she had a duty to decide if the county court has jurisdiction before she filed the lawsuit. ABSOLUTELY NOT. This is a legal question for the court. And further, the Rules are clear, to establish monetary jurisdiction all you need to do is plead, within the Jurisdictional Limits of the Court.
You cannot predict special damages. All you have to do is with good faith plead within the jurisdictional limits of the court.
Sylvia Garza Perez has gotten too comfortable in her position. On balance I think she is a very good clerk. I have personally seen her in the public community computer room helping people. She is very good, when she can, in helping people.
The only person I have heard who will run against her in 2026. is not qualified. It will actually be worse than electing Eric Garza as sheriff. Eric was very good in the clerk's office and should have stayed there.
But when I lose an hour while supervisors debate whether the county court at law has jurisdiction over the case, it is clear Sylvia has failed in train her staff. This is not acceptable. Clerks who practice law need to be fired.
The same exits in Laura Perez-Reyes's office. Concerning the document which they refused to file claiming the pro se has to file it electronically, they are now saying an attorney told them John Doe was not allowed to file documents. This is a question of law. If two people are claiming the right to file documents, then the court must decide the issue as a matter of law, and not the clerk.
It does not end there. John Doe has the right to request subpoenas issued at no cost. Laura Perez staff has made clear the indigent pro se criminal defendant has no right to free service of the subpoenas. It is sad how much of your tax dollars will be used to protect the clerk's office.
Laura Perez-Reyes was never qualified to run the District Clerk's office. When Eric Garza was there, he always made time for me to fix problems. As to Laura she is never in the office. I have so many problems which can be verified in the John Doe case, she merits a removal action.
